Rule 99. Persons who hold position of supervision or management or are engaged in confidential position in a factory under sub-section (1) of section 91 of the Code

(1) The following persons shall be deemed to hold positions of supervision or management, namely:-i. Managing Director, President, Chief Executive Officer, Vice President or General Employer ii. Employers iii. Departmental Heads and Assistants iv. Engineer v. Supervisor or Foremen vi. Labour or welfare Officers vii. Security Officers viii. Safety Officers

(2) Persons defined to holdconfidential position. i. Timekeepers employed in a confidential position in a factory ii. Confidential Assistants/Personal Secretary of Employers or Managing Directors of factories; iii. Staff maintaining personal files/Service Registers

(3) Any other person, so declared as holding positions of supervision or management or holding a confidential position in the Factory in writing, by Chief Inspector-cum-Facilitator;

(4) A list showing the names and designations of all persons to whom the provisions of sub-section(1) of section 91 of the Code have been applied, shall be maintained in every factory.
