Rule 81. Removal of Licence

Chapter XII — FactoriesMade under The Occupational Safety, Health and Working Conditions Code, 2020No. B-11011/12/2026-LESDE, 12 Aug 2026

Official text

(1) The licence of a Factory shall be removed by the Chief Inspector-cum-Facilitator or the Joint Chief Inspector-cum-Facilitator under the following circumstances, namely,-(a) the occupier makes an application in the prescribed Form-XXXI for the removal of the factory;

(b) if a factory is found to be not working during the time of inspection by an Inspector- cum-Facilitator, and the period of licence has expired at the time of inspection is so convinced that the factory is not likely to be restarted, after confirming the same by issuing Notice of intention to remove the licence, the Inspector-cum-Facilitator shall make recommendations to the Chief Inspector-cum-Facilitator or the Joint Chief Inspector-cum-Facilitator to permanently remove the Licence of the saidfactory.
