Rule 147. Appointment of Authority

(1) The Government may appoint an officer in the Labour, Employment, Skill Development & Entrepreneurship Department in the rank of Joint Labour Commissioner as the authority for imposing penalty under sub-section (1) of section 111 of the code after holding enquiry.

Provided in the case of factories the Government may appoint an officer in the Factories and Boilers Department in the rank of Joint Director as the authority for imposing penalty under sub-section (1) of section 111 after holding enquiry.

(2) The State Government may appoint sub-ordinate officers and staff to the enquiry officer as it considers necessary for the efficient discharge of its function under the Code and rule.

(3) The manner of holding enquiry under sub-section (1) of section 111 of the Code shall be followed as prescribed by the Central Government.
