Rule 123. Form and manner of making application under section 90

Official text

(1) The occupier hall makes an application in Form-43 to the appropriate authority.
(2) The appropriate authority shall refer the matter within three days to any officer either not below the rank of Joint Secretary to Government of India or any senior-most officer posted at head-quarter.
(3) The officer authorized in sub-rule (2) shall examine the matter within fifteen days from the date of receipt.
(4) The officer authorized in sub-rule (2) shall submit report within next two days to the appropriate authority.
(5) The appropriate authority shall pass an order within three days from date of receipt of report.
