Rule 21. Composition of the Board

(1) The State Government shall by notification constitute a Board namely the Uttar Pradesh Building and Other Construction Workers Welfare Board under sub-section (1) of section 7 of the Code.

(2) The Board shall consist of, –

(i) the Chairperson shall be an officer not below the rank of Principal Secretary/Seretary nominated by the State Government;

(ii) a member to be nominated by the Central Government;

(iii) the Secretary/Chief Executive Officer of the Board shall not be below the rank of Special Secretary;

(iv) four official members not below the rank of Special Secretary, Government of Uttar Pradesh, nominated by the State Government representing the Social Welfare Department, Finance Department, Basic Education Department and the Department engaged in building and other construction work;

(v) four persons, out of which one shall be a woman, representing the employers of the building and other construction industry, to be nominated by the State Government;

(vi) four persons, out of which one shall be a woman, representing the building workers, to be nominated by the State Government.

(3) Where for any reason whatsoever, it appears to the State Government that it is not in a position to constitute a Board in accordance with the provisions of sub-rule (2), the State Government considers it expedient to do so it may by notification in the Official Gazette, appoint a person to be known as the Administrator (not below the rank of Principal Secretary/Secretary) for a period not exceeding six months or till the Board is duly constituted under sub-rule (2), whichever is earlier.
