Rule 41. Form of single 43. (1) application

A single application, may be filed under subsection (5) of section 45 in Form-III manually with documents or electronically along specified in the said Form. Where an application under sub-section (5) of
(2) section 45 is entertained, the authority shall serve upon the employer electronically or by registered post a notice in Form IV to appear before him on the date specified in the notice with all relevant documents and witnesses, if any, and shall inform the applicant of the date so specified.
(3) If the employer or his representative fails to appear on the specified date, the authority may hear and determine the application ex-parte.
(4) If the applicant or his representative fails to appear on the specified date without any reasonable cause shown in advance, the authority may dismiss the application.
