Rule 38. Deposit undisbursed balance under sub- section (1) (b) of section 44

(1) Where any amount payable to an employee under of 41. this Code remains undisbursed due to the employee not making a nomination or for any other reason and the amount has not been paid to the employee's nominee within six months from the date on which the amount became due, the employer shall deposit the entire amount with the Assistant Labour Commissioner or higher officer having jurisdiction before the expiry of fifteen days from the last day of the said period of six months. A separate bank account shall be opened for this purpose and the amount shall be credited thereto and a record of the same shall be maintained by the authority having jurisdiction.

(2) The amount referred to in sub-rule (1) shall be deposited by the employer with the Assistant Labour Commissioner or higher officer having jurisdiction by way of bank transfer or by way of a crossed demand draft issued from a scheduled bank in India in favour of such Assistant Labour Commissioner or higher officer.
