Rule 47. The manner of payment of wages from security deposit under sub- section (4) of section 55

If the contractor or principal employer does not pay the wages to the contract labour employed by him, the Labour Commissioner, Government of Jammu and Kashmir or his representative or the competent officer as may be notified by Government of Jammu and Kashmir shall conduct or cause to conduct, an inquiry and after giving an opportunity to be heard to the contractor shall pass an order to make payment, if any, of such wages from the amount deposited by the contractor as security deposit and the bills of the contractor as the case may be. The contractor shall re-furnish the security deposit within a period of 30 days or else his license will be liable to be suspended.
