If the application is not dismiss under rule 35 the Competent Authority may, for reasons to be recorded, call upon the applicant to produce evidence in support of the applicant before calling upon any other party, to defend it and if upon considering such evidence, the Competent Authority is of the opinion that there is no case for the relief claimed, he may dismiss the application with a brief statement of his reasons for so doing.
