An employer who intends to close down an industrial establishment to which Chapter X of the Code applies shall apply electronically in FORM- IX for prior permission at least ninety days before the date on which intended closure is to become effective to the State Government, stating clearly therein the reasons for the intended closure of the industrial establishment and simultaneously a copy of such application shall also be sent to the representatives of the workers electronically and by registered post or speed post.
