What job protection is there during pregnancy and maternity leave?
- Your employer cannot dismiss you during, or because of, your maternity absence s. 68(1).
- Being dismissed while pregnant does not take away the benefit you would otherwise have received s. 68(1), first proviso.
- If you are not paid or are dismissed because of your absence, complain to the Inspector-cum-Facilitator s. 72(1), who must decide within 45 days rule 39(1)(b).
