Maternity benefit payment

What to do
Pay the maternity benefit for the period before the expected delivery in advance, when the woman produces proof that she is pregnant, and the rest after proof that she has been delivered of a child s. 62(5).
Who it applies to
Employers covered by the maternity benefit Chapter: every factory, mine and plantation, and every shop or establishment in which ten or more employees are employed, or were employed on any day of the preceding twelve months First Schedule.

When
Within forty-eight hours of proof of delivery, for the period after it s. 62(5).
How
Proof is a certificate in Form X from a registered medical practitioner, an Accredited Social Health Activist or a qualified Auxiliary Nurse and Midwife rule 35(1).
The woman’s notice of claim is in Form XI, though a plain-paper or electronic application may be accepted, and no claim is invalid for not using the form rule 35(2)(a).
Pay the medical bonus along with the maternity benefit rule 35(2)(d).
Pay leave wages for miscarriage, medical termination, tubectomy or related illness within forty-eight hours of the Form X certificate rule 35(2)(f).
If the woman dies, pay her nominee, or her legal representative if there is none, within two months of the date of death rule 35(2)(a), (e).
